Understanding California Break Flags: What the Breaks Scanner Looks For

The California Breaks Scanner helps you catch potential break violations before payroll, but what exactly is it looking for? This article explains each type of break issue the scanner can flag, so you know how to review and resolve them effectively.

What Triggers a Break Flag?

The Breaks Scanner reviews timecard data and Daily Sign Off responses for California employees. It flags the following issues:

  • Missing Breaks

    • No break was recorded when one was required.

      Example: An employee worked a 10-hour shift with no lunch or rest break recorded.

  • Short Breaks

    • A break was recorded, but it was shorter than the required duration (usually 30 minutes).

      Example: An employee’s break lasted only 12 minutes instead of the full 30.

  • Late or Early Breaks

    • A break was taken outside of the required window, typically not within the first 5 hours of work.

      Example: An employee took their break 6 hours after starting their shift.

  • Break Sign Off Issues

    • An employee answered “No” to the Daily Sign Off question about following California break policy.

      Example: The timecard looks fine, but the employee reported they did not take all required breaks.

Why These Flags Matter

Each of these conditions can expose your business to compliance risks under California labor law and PAGA. The Scanner brings those issues front and center, so you can fix them before payroll runs, reducing your legal exposure and creating a stronger break record.

Where Do You See the Flags?

Break issues appear inside the Payroll Scanner, under the All Breaks Compliant section. To view the flagged break entries, click on VIEW. Each flagged employee will have a line item showing what went wrong and which day it occurred.

You can:

  • Click on each row to view the specific time entry with the break issue.

  • Make edits if needed.

Re-run the Payroll Scanner to confirm all issues are resolved.

Best Practice

Pair the Breaks Scanner with:

  • Daily Sign Off (to track employee-reported issues)

  • Minimum Break Duration (to prevent short breaks from being saved)

  • Expanded Timecards (to clearly show break timing and durations)
